Very few armies are going to punish a soldier who achieved something worthwhile. In most cases the soldier would be hurriedly promoted to a higher level according to his maximized ability and beyond it. Refusing to surrender in itself may have a degree of legitimacy in its own right. It would all depend on the situation. How well the soldier or his advocates explain his actions would also have an effect.
